Obama Administration Recognizes Mass for Transgender Student Policy

The Department of Education and Justice acknowledged Massachusetts on Friday through guidance on Lesbian, Gay, Bisexual, Transgender, Queer and Questioning (LGBTQ), citing Massachusetts as an example of a state already implementing policies in schools. 

The Massachusetts Commission on Lesbian, Gay, Bisexual, Transgender, Queer and Questioning announced its strong support for the guidance released by the Obama Administration. 

The guidance asks public schools across the country to allow transgender students access to bathrooms and locker rooms that match their gender identity. 

“The Commission on LGBTQ Youth and our partner education agencies have been well ahead of the curve on promoting equity, fairness, and dignity for transgender youth. It is humbling to see the Obama Administration look to Massachusetts as a model to ensure that all students are treated equally in public schools nationwide,” said Julian Cyr, a Commission member who chaired the Commission when the ESE guidance was released. 

Legislation passed in 2011 in Massachusetts that went into effect on July 1 of 2012, created non-discrimination protections for transgender students in public schools. 

Guidance released in early 2013 by the Department of Elementary and Secondary Education has enabled schools across Massachusetts to successfully implement the law that has been a model for other states, as well as for the Departments of Education and Justice.

“As a state, Massachusetts has pioneered guidance that has protected transgender students in public schools,” said Jeff Perrotti, Director of the Safe Schools Program for LGBTQ Students. “Schools across the Commonwealth have implemented guidance on transgender equality for years now with great success. We are heartened that Massachusetts is a leader in inspiring other states, and now the federal government, to develop similar guidance.” 

The Commission on LGBTQ Youth

The Commission on LGBTQ Youth is established by law as an independent state agency to recommend and advocate to all branches of state government effective policies, programs and resources for LGBTQ youth to thrive.  Founded in 1992 as the first body of its kind in the nation, the Commission has been advocating for LGBTQ youth wellbeing in and out of school for more than two decades.
