Three Men Arrested in Worcester on Drug Charges

James Bourget, 51, of Worcester was charged with Possession of Class A Substance (heroin) and Possession of Class B Substance (cocaine).
Mario Galan, 25, of Worcester was charged with distribution of class A substance and distribution of class B substance, conspiracy and operating a MV with a revoked license.
Jason Fontanez, 25, of Worcester was arrested at the scene and charged with distribution of Class A Substance, distribution of Class B substance and Conspiracy to Violate Drug Laws.
The Incident
On Friday, May 19 members of the WPD Vice Squad were in possession of three search warrants. The first warrant was for 40 Upsala Street with Fontanez of the same address, being the named target. The second warrant was for 51 Wall Street and the third warrant was for a car which was identified as a 2008 Infinity. The target for the second and third warrants was for Galan.
The warrants were the result of an ongoing drug investigation in which it was determined that Fontanez and Galan distributed illegal narcotics together.
At approximately 11:00 a.m., members of the vice squad set up surveillance for the Wall Street and Upsala Street addresses. At approximately 12:00 p.m., the undercover officers saw Galan driving the Infinity away from the Wall Street address. The passenger seat contained Fontanez while another unknown man sat in the back seat. Undercover officers followed the car until they approached the intersection of Houghton and Dorchester Streets. At this location the suspect car pulled to the side of the road. Moments later the officers saw a white Hyundai pulled to the side of the road next to the suspect car. A man, later identified as Bourget, exited the Hyundai and approached the driver’s door. The officers observed a street level drug transaction take place. After the brief exchange Bourget got back into the Hyundai and drove off. The suspect car drove off in a different direction. Undercover officers split up and each followed a car.
The Hyundai was stopped in the location of 783 Grafton Street. Bourget was given an explanation why he was stopped. A subsequent search of Bourget produced a bag of heroin in his pocket and a loose chunk of crack cocaine inside the car. Police placed him under arrest.
Surveillance of the two properties continued. At approximately 4:00 p.m. the suspect vehicle arrived back at the Wall Street address. Galan and the man sitting in the back seat exited the Infinity and went inside the apartment. After a few minutes the two emerged with one carrying a backpack. The men entered a different vehicle this time, a 2004 Honda Accord. The Honda drove off. Undercover officers attempted to follow the Honda but the driver was operating the vehicle erratically and at a high rate of speed. As a result, the undercover officers lost sight of the Honda.
However, the Honda ended up at the Upsala address where vice officers were still positioned. Fontanez was seen entering the apartment. The Honda drove off. Some of the officers prepared to enter the apartment while others followed the Honda once again. At approximately 4:25 p.m., the Honda was stopped at on Grafton Street at Rice Square. Officers approached the vehicle. Galan was operating the car. Galan was removed from the vehicle and placed under arrest. Galan. The male that was originally seen in the back seat had no existing warrants and a search of his person produced negative results. The person was allowed to leave. Galan was also additionally charged with a second count of Distribution of Class A Substance based on surveillance that the officers had on him on May 17th.
At approximately 4:33 p.m., officers made entry into the Upsala Street apartment. Fontanez was the only person inside. The search produced two cell phones, two scales, $340 in cash and other drug paraphernalia.
At approximately 5:00 p.m., members of the Vice Squad executed the search warrant for the Wall Street address. A woman and two small children were inside. The search produced $5,008 in cash, crib notes pertaining to the drug trade, a stun gun, a bag of heroin, personal paperwork belonging to Galan and Fontanez, three cellphones, baggies, a scale and other drug paraphernalia.
The officers seized all cash and drugs as evidence. The officers also seized the Infinity and will be proceeding with the forfeiture of the car.
All three suspects will be arraigned on Monday, May 22, 2017 at the Worcester County District Courthouse.
